1. Scope

The following Terms and Conditions apply to all orders placed via our online shop. Our online shop is for consumers only.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

The following applies in addition for individual countries:

For Germany: Consumers within the meaning of § 13 of the German Civil Code (BGB) are any natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business or profession.

For Austria: In the following conditions, "consumer" means "Konsument" within the meaning of the Austrian Consumer Protection Act (KSchG).

For the other Member States of the European Union: The definition of consumer under the applicable national law implementing Directive 2011/83/EU shall govern. Mandatory consumer protection provisions of the State in which you have your habitual residence remain unaffected.

For Switzerland: In the following conditions, "consumer" means "Konsument" under Swiss law.

2. Contractual partner, formation of contract, options for corrections

The contract is concluded with OSIKO GmbH.

By placing the products in the online shop, we make a binding offer on our part to enter into a contract regarding those items. You may place our products in the shopping basket without obligation and amend your entries at any time prior to submitting your binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the products contained in the shopping basket. Once you have sent your order you will immediately receive a confirmation via e-mail.

3. Contract language, saving of the contract text

The language(s) available for concluding the contract: German, English

We save the text of the contract and forward the order data and our Terms and Conditions to you on a durable medium. For security reasons, the text of the contract cannot be accessed via the internet.

4. Subject matter of the contract

4.1 Product description

We draw your attention to the fact that the respective product description forms an essential part of the contract.

4.2 Product images

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following particularities. If you have any doubts, please contact us:

Due to individual screen configurations (e.g. resolution and brightness), slight deviations between the colours displayed and the actual product colours are possible.

In the case of natural leather, deviations in grain, texture and colour are possible. These are characteristic of the material and do not constitute a defect.

4.3 Right of use

Any sketches, drafts, preliminary products etc. created by us in performance of the order are legally protected. We grant you a simple, non-exclusive right to use them for the purpose of performing the order to the extent contractually agreed.

5. Delivery conditions

5.1 Delivery area

We deliver to all Member States of the European Union and to Switzerland.

The delivery costs and delivery times applicable to your country of delivery are displayed during the ordering process before you submit your order.

5.2 Delivery options

We ship the products to the delivery address specified in the order process.

We only dispatch goods en route; pick up by the customer is not possible.

6. Payment

6.1 Prices

The prices stated at the time of the order shall apply. These are total prices and include statutory value added tax.

6.2 Due date and default of payment

The price is due upon conclusion of the contract, unless a later date results from the payment conditions set out below.

For customers domiciled in the European Union: In the event of default of payment, we reserve the right to charge you a fee of EUR 1.50 per reminder for the second and each subsequent reminder. You retain the right to prove that a lesser loss has been incurred. Further claims remain unaffected. Mandatory provisions of the law of your country of residence which exclude or limit the reimbursement of reminder costs remain unaffected.

For customers domiciled in Switzerland: In the event of default of payment, we reserve the right to charge you a fee of CHF 1.50 per reminder for the second and each subsequent reminder. You retain the right to prove that a lesser loss has been incurred. Further claims remain unaffected.

6.3 Payment methods

The following payment methods are available in our online shop. Which payment methods are offered to you may depend on your country and the currency selected.

Payment processing via Shopify Payments

Unless otherwise specified below, payment is processed by the payment service provider Shopify International Limited, Victoria Buildings, 2nd Floor, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"). Shopify may use further payment services for processing, to which separate conditions may apply; you will be informed of these during the ordering process.

Credit and debit card

You can pay with Visa, Mastercard, American Express, Maestro and UnionPay. You provide your card details during the ordering process. Your card will be charged immediately after placing your order.

Apple Pay

Apple Pay is a payment service provided by Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland ("Apple"). This requires an Apple device with Apple Pay activated and a payment card stored therein. You confirm the payment on your device; the stored card will be charged immediately after placing your order.

Google Pay

Google Pay is a payment service provided by Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). This requires a Google account with Google Pay activated and a payment card stored therein. You confirm the payment in your Google account; the stored card will be charged immediately after placing your order.

Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna") we offer you the Klarna payment options displayed during the ordering process. Payment is made directly to Klarna and generally requires a successful address and credit check. Klarna will inform you during the ordering process which options are available to you, which payment terms apply and which conditions apply in detail. The Klarna payment options can only be used by consumers.

Klarna may offer additional payment options in the customer account to registered Klarna customers selected according to Klarna's own criteria. We have no influence on the offering of such options; they form part of your legal relationship with Klarna.

Bancontact (for customers in Belgium)

You will be redirected to your bank's interface or banking app to confirm the payment. Your account will be debited immediately after completion of the payment process.

EPS bank transfer (for customers in Austria)

You will be redirected to your bank's online banking interface, where you confirm the transfer. Your account will be debited immediately after completion of the payment process.

iDEAL (for customers in the Netherlands)

You select your bank and confirm the payment in its online banking system or banking app. Your account will be debited immediately after completion of the payment process.

MobilePay (for customers in Denmark and Finland)

MobilePay is a payment service provided by Vipps MobilePay AS, Dronning Eufemias gate 11, 0150 Oslo, Norway. This requires the MobilePay app with a payment method stored therein. You confirm the payment in the app; the charge is made immediately after placing your order.

TWINT (for customers in Switzerland)

TWINT is a payment service provided by TWINT AG, Konsumstrasse 20, CH-3007 Bern, Switzerland. This requires the TWINT app with a linked bank account or card. You confirm the payment in the app; the charge is made immediately after placing your order.

PayPal, PayPal Express

In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimise yourself with your access data and confirm the payment instruction. The payment transaction will be processed by PayPal immediately after placing the order. You will receive further instructions during the ordering process.

PayPal may offer registered PayPal customers further payment modalities in the customer account selected according to its own criteria. However, we have no influence on the offering of these modalities; further individually offered payment modalities affect your legal relationship with PayPal. You can find more information on this in your PayPal account.

7. Retention of title

The products shall remain our property until full payment is made.

In the case of customers domiciled in Switzerland, we are entitled to make a corresponding entry in the register of retention of title.

8. Damage during delivery

If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

9. Warranty and guarantees

Liability for defects

The statutory provisions on liability for defects shall apply.

Information for consumers in the European Union:

When purchasing goods, the warranty period is at least two years. Under the law of individual Member States a longer period may apply; the mandatory provisions of the State in which you have your habitual residence shall govern. For goods sold to consumers with their habitual residence in Spain, the statutory warranty is extended to three years. Please also refer to the harmonised notice pursuant to Implementing Regulation (EU) 2025/1960 regarding warranty rights for goods (so-called "guarantee label").

Where you exercise your warranty rights and we consider it necessary to receive the goods back in order to examine your complaint, you shall return the goods at our cost to the address provided for this purpose.

The following applies to consumers domiciled in Switzerland:

You shall examine the condition of the goods received as soon as is customary in the ordinary course of business and, if defects are found for which the seller is liable, notify the seller immediately. If the consumer fails to do so, the goods purchased shall be deemed accepted, except in respect of defects that were not detectable upon customary examination. If such defects become apparent at a later date, notification must be given immediately upon discovery; otherwise the goods shall be deemed accepted in respect of these defects as well.

By way of derogation from the above: Where defects in goods that have been incorporated as intended into immovable works have caused the works to be defective, such defects must be notified within 60 days. Defects that were not detectable upon customary examination must be notified within 60 days of their discovery.

Please return the defective product to us together with a description of the defect. You shall bear the transport costs incurred. We provide warranty by remedying defects. At our discretion, this is done either by rectifying the defect (repair) or by supplying goods free of defects (replacement). If subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. A right to a reduction in price is excluded.

Information on any additional voluntary guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop, if applicable.

We normally respond to e-mail enquiries within two working days.

10. Liability

Towards consumers domiciled in Austria we are liable without limitation in all cases.

Otherwise the following applies:

We are liable without limitation for claims due to damages caused by us, our legal representatives or vicarious agents

• for injury to life, limb or health,
• for deliberate or grossly negligent breach of duty,
• for guarantee commitments, where agreed, or
• to the extent that the scope of the Product Liability Act applies.

In the event of a breach through slight negligence by us, our legal representatives or vicarious agents of material contractual obligations, the fulfilment of which is essential to the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), liability is limited in amount to the foreseeable damage typical of the contract at the time of its conclusion.

Otherwise, claims for damages are excluded.

12. Dispute resolution

We are neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration body.

Should individual clauses of these Terms and Conditions be wholly or partly invalid, the remainder of the contract shall remain effective. To the extent that individual clauses are invalid, the content of the contract shall be governed by the statutory provisions.
